DIVORCE

In Louisiana, the physical separation period prior to finalizing any divorce is 6 months if no minor children are involved, and 1 year if minor children are involved. These physical separation periods may be bypassed under a fault-based divorce, which we can discuss in more detail with you. Further, we will address any and all incidental matters to your divorce, which include, but are not limited to, child custody, child support, spousal support, and division of community property.

CHILD CUSTODY

Child Custody involves either joint or sole custody, and typically involves one parent being designated as a domiciliary parent, with an access schedule established with the children that will include visitation periods  during the school year, summer months, and holidays.

CHILD SUPPORT

Child support is calculated using the parties’ gross monthly incomes, and will include other expenses incurred on behalf of the children such as health insurance premiums, child care costs, school tuition and costs, and medical expenses not covered by insurance. The amount of child support to be paid will also depend on your custody arrangement with the child(ren).

SPOUSAL SUPPORT

Spousal support includes temporary and permanent support, and is need based, meaning that the party requesting the support must have a need for it, and the other party must have the ability to pay. The Court also considers the lifestyle of the parties when calculating spousal support.

PARTITION OF COMMUNITY PROPERTY

When partitioning community property, the Court’s objective is to equally divide any and all property between the parties. In doing so, we will assist you with valuing each item of your community property, calculating any and all community debts, and calculating any and all reimbursement claims you might possibly have.
